Terms of Service
Last updated 2026. These terms apply to this website and to all NXT Retreats registrations. See also our Privacy Policy.
- Section 1
Who we are
NXT Retreats is a brand operated by Mentor Pods, a DBA of Kobayashi Maru Enterprises LLC ("KME", "we", "us"). These Terms of Service govern your use of this website and any retreat seat you purchase through it. By using the site or registering for a retreat, you agree to these terms. If you do not agree, please do not use the site.
- Section 2
Eligibility and accounts
You must be at least 18 years old to register for a retreat or submit an application. You agree that the information you provide is accurate and current, and that you are responsible for any activity that occurs under your registration or login. Retreats are invitation based, and we may decline or revoke a registration at our discretion, including where an application is incomplete, inaccurate, or a poor fit for the group.
- Section 3
Registrations, pricing, and payment
Prices, seat counts, promotional codes, and deadlines shown on the site are subject to change until a registration is completed. The price you see at checkout is the price that applies to your registration. Payments are processed by our third-party payment provider; we do not store your full card details. Where a deposit option is offered, the remaining balance is due by the date shown at checkout and in your confirmation email, and failure to pay the balance by that date may result in the loss of your seat.
- Section 4
Cancellations, transfers, and changes
Seat purchases are final and non-refundable. Seats are transferable: you may transfer your seat to another eligible person with our written approval, or apply the amount you paid as a credit toward a future NXT Retreat or an equivalent Mentor Pods engagement. Credits expire 18 months from the original retreat date. If we must cancel or materially change an event due to circumstances outside our reasonable control, our responsibility is limited to providing a credit of equal value toward a future event or program.
- Section 5
Participation
Attending a retreat is also subject to our participant agreement, which covers conduct, health and safety, confidentiality, assumption of risk, media release, and intellectual property. We provide the current participant agreement to registered attendees before the event. Attendance is conditional on accepting it.
- Section 6
Acceptable use of this site
You agree not to misuse the site: no attempting to access accounts or data that are not yours, no probing or interfering with the site's security or availability, no scraping or automated bulk collection of content, no uploading malicious code, and no using the site for unlawful purposes or to send unsolicited messages to others.
- Section 7
Intellectual property
The site, its content, branding, copy, photography, and materials are owned by KME or its licensors and are protected by intellectual property laws. You may view and share pages for personal, non-commercial purposes. You may not copy, republish, or resell our materials without written permission. Anything you personally create or build during a retreat remains 100% yours; we claim no ownership, equity, or license in your work.
- Section 8
No professional advice and no guarantees
Content on this site and at our events is educational and coaching in nature. It is not legal, tax, medical, financial, or investment advice, and nothing on this site is a promise or projection of any specific result, revenue, or outcome. Any decisions you make based on our content are your own responsibility.
- Section 9
Third-party services and links
We rely on third-party providers for payments, email delivery, hosting, hotels, venues, and analytics, and the site may link to third-party websites. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply to your use of them.
- Section 10
Disclaimers and limitation of liability
The site is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, KME and its owners, employees, and contractors are not liable for indirect, incidental, special, or consequential damages, and our total aggregate liability for any claim relating to the site or a retreat is limited to the amount you paid to us for the applicable seat or service.
- Section 11
Governing law and disputes
These terms are governed by the laws of the United States and the state in which KME is organized, without regard to conflict of law rules. Before filing any formal claim, you agree to contact us in good faith so we can try to resolve the issue directly.
- Section 12
Changes and contact
We may update these terms from time to time. The version posted on this page is the version that applies, and continuing to use the site after an update means you accept the revised terms. Questions about these terms can be sent to info@mentorpods.com.
